Calixto [also spelled Calisto] C. Cabaltero (born October 14, 1911 in the Philippines; died May 26, 2001 in California) was
convicted of the 1936 robbery of farm owner J. Nishida near Campbell, California. During the robbery, one of the participants
was shot dead. Cabaltero and the five other robbers were convicted of first degree robbery and murder and imprisoned at San
Quentin State prison. He and the other defendants appealed the murder conviction. The resulting First Appellate Court's decision
to uphold the murder conviction set a legal precedent for the section of the California Penal Code mandating that a homicide
committed during a another crime would be treated as first degree murder. Calbaltero is buried in Cypress Memorial Lawn Park
in Colma, California.
